Terms of Service

These Terms of Service govern your access to and use of Flow, a client management platform for businesses. By creating an account, accessing Flow, or using the platform, you agree to these Terms.

If you are using Flow on behalf of a business or organization, you represent that you have authority to accept these Terms on behalf of that business or organization.

1. The Flow Service

Flow provides tools for client management, contact management, opportunities, workflows, tasks, files, scheduling, communications, forms, reports, integrations, and related business operations.

Flow may update, improve, modify, or remove features over time. Flow will make reasonable efforts to avoid materially reducing core functionality without notice.

2. Accounts and Workspaces

You are responsible for maintaining accurate account information and keeping your login credentials secure. You are responsible for all activity that occurs under your account or workspace, including activity by invited team members.

You must notify Flow promptly if you believe your account has been compromised.

3. Workspace Data and Ownership

You retain ownership of the data you or your team add to Flow, including client information, contacts, notes, files, messages, workflows, tasks, forms, and business records.

You grant Flow a limited license to host, process, transmit, display, and use workspace data only as needed to provide, secure, maintain, and improve the Flow service, comply with your instructions, provide support, and meet legal obligations.

Flow does not sell workspace data. Flow does not use workspace data for third-party advertising.

4. Privacy

Your use of Flow is also governed by the Flow Privacy Policy.

Flow is designed around user privacy. Flow does not voluntarily share user workspace data with law enforcement or government agencies. If legally required to respond to a valid legal request, Flow will review the request, limit disclosure where possible, and notify affected users unless legally prohibited.

5. Acceptable Use

You agree not to use Flow to:

  • Violate any law or regulation.
  • Infringe the rights of others.
  • Upload malicious code, malware, or harmful content.
  • Attempt to gain unauthorized access to Flow or another user’s workspace.
  • Interfere with the security, reliability, or performance of Flow.
  • Send spam, unlawful communications, or messages without required consent.
  • Misrepresent your identity or business.
  • Use Flow for harassment, abuse, fraud, or deceptive practices.
  • Reverse engineer, scrape, or exploit the platform except where allowed by law.

6. Communications, Phone, Email, and Messaging

Flow may provide email, phone, SMS, workflow, and communication tools. You are responsible for ensuring that your use of communications features complies with applicable laws, including consent, opt-out, marketing, privacy, call recording, and messaging rules.

If Flow provides phone or messaging features, usage may be subject to additional limits, carrier rules, registration requirements, fees, and overage charges. Flow may suspend messaging or phone features if usage creates compliance, deliverability, fraud, abuse, carrier, or operational risk.

7. Integrations

Flow may allow you to connect third-party services. By connecting an integration, you authorize Flow to access, process, send, and receive information from that service as needed to provide the integration.

You can disconnect integrations from your settings. Disconnecting an integration may stop sync features or remove access to related functionality. Third-party services are governed by their own terms and privacy policies. Flow is not responsible for third-party services outside Flow’s control.

8. Billing and Payments

Paid plans, add-ons, usage fees, phone numbers, message usage, call usage, storage, workflow usage, and other billable features may be charged to your workspace account.

You authorize Flow and its payment processor to charge applicable fees, taxes, usage charges, overages, and recurring subscription amounts. Unless stated otherwise, fees are non-refundable except where required by law or expressly agreed by Flow.

If payment fails or your account becomes overdue, Flow may limit, suspend, or terminate access to paid features.

9. Trials and Promotions

Flow may offer free trials or promotional access. Trial terms may vary. At the end of a trial, access may be limited unless a paid plan is activated. Flow may change or end promotional offers at any time.

10. Security

Flow uses reasonable safeguards designed to protect user data. However, no system is completely secure. You are responsible for using strong passwords, protecting account credentials, enabling available security features, limiting workspace access, and promptly removing users who should no longer have access.

11. Support

Flow may provide support through in-platform tools, email, or other available methods. Support availability may vary by plan. You can contact Flow at support@myflowportal.com.

12. Service Availability

Flow works to keep the platform reliable and available, but Flow does not guarantee uninterrupted or error-free service. Flow may be unavailable due to maintenance, updates, outages, third-party service issues, or events outside Flow’s control.

13. Beta Features

Some features may be released as beta, preview, experimental, or early access features. These features may change, break, or be removed at any time and may not be covered by the same support commitments as generally available features.

14. Suspension and Termination

You may stop using Flow at any time. Flow may suspend or terminate access if you violate these Terms, payment is overdue, usage creates security, legal, abuse, carrier, compliance, or operational risk, Flow is required to do so by law, or continuing service would create harm to Flow, users, or third parties.

Upon termination, your access to the platform may stop. Certain data may be retained as described in the Privacy Policy.

15. Disclaimers

Flow is provided “as is” and “as available” to the maximum extent allowed by law. Flow does not guarantee that the platform will be uninterrupted, error-free, secure, or meet every business need.

Flow is not legal, financial, tax, compliance, or professional advice. You are responsible for your own business decisions and compliance obligations.

16. Limitation of Liability

To the maximum extent allowed by law, Flow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, business interruption, or loss of goodwill.

To the maximum extent allowed by law, Flow’s total liability for claims related to the service will not exceed the amount paid by you to Flow in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some limitations may not apply.

17. Indemnification

You agree to defend, indemnify, and hold harmless Flow from claims, damages, liabilities, losses, costs, and expenses arising from your use of Flow, your workspace data, your violation of these Terms, your violation of laws or third-party rights, or your communications with clients, contacts, or third parties through Flow.

18. Changes to These Terms

Flow may update these Terms from time to time. If changes are material, Flow will provide reasonable notice. Continued use of Flow after changes become effective means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of New York, without regard to conflict-of-law rules. Any disputes will be handled in the courts located in New York City, New York, unless another process is required by law.
